Wolt Couriers in Denmark Reclassified as Workers, Gaining EU Rights

The Danish authorities have said that Wolt courier partners can now be registered as workers in the country when applying for a residence document under the European Union regulations.

Wolt is a technology company where the couriers decide how much and when they want to work.

So far, the Danish Agency for International Recruitment and Integration (SIRI) has registered Wolt courier partners as self-employed people or as people who do not have sufficient funds, as it was considered that Wolt was not the couriers’ employer.

However, following an evaluation, SIRI has decided to adjust its practice and recognise Wolt as the employer of the couriers, meaning that couriers can now be registered as workers provided that the other conditions for obtaining the status are fulfilled.

SIRI assesses that Wolt, in connection with the evaluation of residence under the EU regulations as a rule, shall be considered as employer for the couriers, and the couriers can thus be considered as workers if the other conditions for obtaining status as a worker are fulfilled. – SIRI

Following the newly made changes, Wolt couriers who want to be registered as workers must make sure to submit several documents for their application to go smoothly.

As SIRI explains, Wolt couriers wanting to be registered as workers must prove that they have a courier partner agreement with Wolt.

Moreover, they must also prove that they have been working as a courier for the last three months and that the work is of a certain scale. These can be proved by submitting paychecks.

As for those who are courier partners for Wolt and currently registered as people with sufficient funds, SIRI said that they also have the opportunity to apply for re-registration as a worker under the EU regulations.

Regarding Wolt couriers registered as self-employed, SIRI stressed that they are already registered under the EU Residence Order, and thus, this practice will not affect them.

In addition, SIRI highlighted that the adjusted practice will not affect other companies. This means that couriers from other companies will not be able to apply to be registered as workers under EU regulation.

However, if Wolt makes any changes to its structure in the future, its couriers may be affected and no longer be permitted to be registered.
